Release and Waiver of Liability
By voluntarily participating as a student of Sytera Yoga LLC (doing business as “SYTERAYOGA”), 6888 Elm Street, Suite 1-C, McLean, VA 22101 and 901 Glyndon St SE #102, Vienna, VA 22180, whether in studio, outdoors, or online, I represent and hereby agree as follows:
I am or will be participating in yoga classes, programs, or workshops (referred to as “Yoga Classes” in the waiver) offered by SYTERAYOGA in studio, outdoors, and/or online, during which I will receive information and instruction about yoga and health. These Yoga Classes may entail intensive physical activity and exertion by me. I recognize that such physical activity and exertion may be difficult and strenuous and may cause or aggravate a physical injury or medical condition. I am fully aware of and accept the risks and hazards involved.
I understand that it is my responsibility to consult with a physician prior to and regarding my participation in Yoga Classes and to receive prior approval to participate. I represent and warrant that I am physically fit and that I have no medical condition or injury that would prevent my full participation in Yoga Classes offered in studio, outdoors, or online.
In consideration of being able to participate in Yoga Classes, whether online, outdoors, or in studio, I agree to assume full responsibility for any risks, conditions, injuries or damages, known or unknown, which I might incur or aggravate as a result of my participating. I understand that during in-studio and outdoors classes, there may be physical assisting and/or adjustments by the teacher from time to time and that it is my responsibility to let the teacher(s) know if I do not want to be touched/adjusted.
In further consideration of being permitted to participate in Yoga Classes, whether online, outdoors, or in studio, I knowingly, voluntarily, and expressly waive any claim I may have or acquire against SYTERAYOGA, or the teacher(s), for any injury, condition, or damages that I may sustain as a result of entering or being on the premises or participating in Yoga Classes.
I, my heirs, or legal representatives forever release, waive, discharge, and covenant not to sue SYTERAYOGA, or the teachers, for any injury, condition, or death which arises, is caused by, or is aggravated by reason of my participation in Yoga Classes.
All payments made by me for online, outdoors, or in-studio classes, class packages, and membership fees are non-refundable and non-transferable. I also state that I have no claims against SYTERAYOGA, or the teacher(s), by reason of their refusal to allow me to participate in the Yoga Classes.
I hereby give permission for images of myself or my child, captured during the Yoga Class, whether in studio, outdoors, and/or online, through video, photography, and/or digital camera, to be used for the purposes of promotional materials and live-streaming, and I waive any rights of compensation or ownership thereto.
As with the transmission of any communicable disease like a cold or the flu, I may be exposed to COVID-19, also known as the “Coronavirus,” at any time or in any place. I understand there is a chance that I could be exposed to an illness at SYTERAYOGA or near the studio (e.g., in the parking lot for outdoor yoga), just as I might be at a gym, grocery store, or a restaurant. Although exposure to the Coronavirus and other communicable diseases is unlikely, I knowingly, voluntarily, and expressly accept the risks and waive any claim I may have or acquire against SYTERAYOGA, or the teacher(s), for any illness or infection that I may sustain as a result of entering or being on the premises or participating in Yoga Classes.
I have read the above Release and Waiver of Liability and fully understand its contents. I am legally competent to sign and voluntarily agree to the terms and conditions stated above.
